These Terms of Service (“Terms”) govern your use of the Scène mobile application (the “App”), operated by CHUM Man Lee, an individual based in Hong Kong (“we”, “us”, or “our”). By downloading, accessing, or using the App, you agree to these Terms.
You must be at least 13 years old to use the App. If you are under the age of majority where you live, you may use the App only with the involvement of a parent or legal guardian who agrees to these Terms. By using the App you represent that you meet these requirements.
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the App for your own personal, non-commercial purposes, subject to these Terms and to the rules of the app store from which you obtained the App.
The App uses generative AI (Google’s Gemini models) to create images and text. AI output can be inaccurate, unexpected, stylised, or not fully representative of any real person or event. Generated content is provided for personal, creative, and journaling purposes only, and must not be relied upon as fact or advice. You are responsible for how you use and share generated content, including any use of a person’s likeness.
You agree not to: (a) use the App for any unlawful purpose; (b) attempt to reverse engineer, decompile, or interfere with the App except as permitted by law; (c) use the App to create content that impersonates, harasses, defames, or infringes the rights of others; (d) attempt to circumvent usage or safety limits of the underlying AI services; or (e) use the App in a jurisdiction where it is not available (see Section 10).
The App relies on services provided by Google (Firebase AI Logic and Gemini) and by Apple (the App Store and device features). Your use of those services is also subject to their respective terms. We are not responsible for third-party services, and their availability or behaviour may change.
The App itself — including its name, design, code, and branding — is owned by us and protected by law. Except for the licence expressly granted above, no rights are transferred to you.
THE APP AND ALL GENERATED CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT GENERATED CONTENT WILL MEET YOUR EXPECTATIONS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP. TO THE EXTENT LIABILITY CANNOT BE EXCLUDED, OUR TOTAL AGGREGATE LIABILITY IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) HKD 100. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
The App is not offered for use in mainland China, Russia, or Türkiye. You are responsible for complying with the laws of your location, including any export-control or sanctions laws, and you represent that you are not located in a restricted region or on a restricted-party list.
You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of Your Content, your use of the App, or your violation of these Terms or of any law or third-party right.
You may stop using the App at any time by deleting it. We may suspend or terminate your access if you breach these Terms or if we discontinue the App. Sections that by their nature should survive termination will survive.
These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-laws rules. You agree to submit to the exclusive jurisdiction of the courts of Hong Kong, subject to any mandatory consumer-protection rights you have where you live.
We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date and, where appropriate, by notice in the App. Continued use after changes take effect constitutes acceptance.
